Elizabeth [-?-] was named in the will of William Dulin as his wife 26 November 1756 in Truro Parish, Fairfax Co, Virginia Colony.1

Elizabeth Dulin, widow, was a tenant on 200 acres of land owned by Henry Fitzhugh at the northern boundary of the old Ravensworth tract in Fairfax County. She is located on the 1760 map as Widow Dulin and she held three slaves - her name is located just west of "John Dulin." This land is approximately where today's Woodburn Road crosses Accotink Creek and, if the map is accurate, they probably held land adjacent to the creek. They are not far from the home of James Dove, perhaps a mile-and-a-half south of his property. Some of this information was obtained from the papers of Henry Fitzhugh, Ravensworth Rent Lists, held at the Virginia Historical Society, Richmond, Virginia.2

Elizabeth [-?-] died between April 1760 and 21 October 1760 in Fairfax Co, Virginia.3,2

The bond for managing the estate of Elizabeth Dulin was filed 21 Oct 1760 in Fairfax Court and amounted to 1000 pounds. The bond was executed by William Dulin, Edward Dulin, William Donaldson and Daniel Mills.3

The estate of Elizabeth [-?-] was inventoried 19 May 1761 and was performed by Robert Thomas, John Summers and John Batchy[?]; returned to Fairfax Court on 19 May 1761.4

An account of her estate was returned to Fairfax Court on 17 Feb 1762 and included a number of payments to her family. The following is a transcription of part of the inventory:

Elizabeth provided an affidavit 5 Dec 1748 regarding visitors to her house in Rahway in a matter concerning the "rioting" at Newark and Perth Amboy. She was a widow and had a son named John Bird - she ran a tavern at her house.6

Eve [-?-] was born in 1744/45 (tombstone: Eve Rogers, aged 82 years.)1

Eve married second Noah Cole 25 May 1799 in Gloucester Co, New Jersey.4,5,6

At the June 1801 term for the Gloucester County Orphans Court, Eve Cole asked for John Dell to be appointed guardian for John Rodgers minor children, John and Thomas, both under age 14.7

Eve [-?-] was mentioned in the following event: Eve Rodgers, widow of John Rodgers, married Noah Cole 25 May 1799. They brought a court action against Philip Stoy and John McClane, administrators of the will of John Rodgers, claiming that they did not complete the settlement. The court finally decided, after examining the settlement papers, that there were not sufficient funds in the estate to make payment and that, in fact, over $400 was due. Since no one came forward to claim payment, the court declared the account be confirmed and allowed. No payment was made.4,8


Noah Cole and his wife, Eve (widow of John Rogers), retained Robert Pearson as their attorney to sue for her right of dower in the New Jersey Supreme Court in Trenton during the Court’s September and November terms, 1816.

They sued Benjamin Tomlinson for a third part of one house, one barn, one hundred acres of woodland, and sixty acres of arable land with their appurtenances Gloucester Township, Gloucester County. It is possible that Benjamin was the husband of one of the daughters of John and Eve Rogers and that he had taken possession of part of the property left by John Rogers (since no mention was made of a spouse of Tomlinson, she is probably deceased).

They also sued John Rogers (son of the deceased John Rogers and possibly son of Eve Rogers) for Eve’s dower part of two properties: one of twelve acres of meadowland with appurtenances in Greenwich Township, Gloucester County; another of one house, one barn, one stable, one garden, one orchard, ten acres of meadow land, one hundred & fifty acres of arable land, and fifty acres of woodland with appurtenances in Gloucester Township, Gloucester County (this property description is the same property description as that of Benjamin Tomlinson).

Benjamin Tomlinson: 1830 and 140 census for Gloucester County, New Jersey; born 1780-1790; spouse of same age in both records. At Ancestry.com, Benjamin Tomlinson, b. 1782, d. 1843 - this appears to the Benjamin Tomlinson who was brought to court.

A detailed examination of the deeds/property mentioned would probably reveal more information on Benjamin Tomlinson and whether he, in fact, married a daughter of John Rodgers/Rogers. Deeds for the period 1797-1820 may provide the information needed. The will of John Rodgers/Rogers sheds no light on Tomlinson but does list his daughters, several of them unmarried at the time of the will in 1797.

This does establish that Eve [-?-], wife then widow of John Rogers, then wife of Noah Cole, was alive in late 1816.9,10

Why was Eve Rodgers/Rogers buried next to her first husband, John Rodgers, and not with Noah Cole, her second husband? Her name should have been listed as Eve Cole. This needs research but, so far, there seems to be only one Eve Rogers/Cole in Gloucester County at this time.
